Family Civil Rights

We wish we could say that we rarely see civil rights violations, but unfortunately it is a regular occurrence in child welfare (DCF) cases. Just a few examples of cases we have recently handled:

  • Longterm caregivers who are barred from being meaningfully heard in court, even when the court is making permanent decisions about the child’s adoptive family.
  •  Government agencies–like DCF and the Statewide Guardian Ad Litem Office–that abuse their power with misrepresentations, refusal to carry out their legal obligations, frivolous claims, and abuse of court process.
  • The legislature’s failure to safeguard the separation of powers between courts and government agencies, resulting in secret government tribunals and kangaroo court-like proceedings.
  • Laws and regulations that ban loving, rehabilitated adults from adopting based on decades-old crimes that having nothing to child safety. And laws and regulations that ban fit birth parents from making adoption plans for their children.
  • Equal protection of children and parents involved in adoption and child welfare proceedings.
  • Prior restraints on freedom of speech

Jay & Campbell’s experience in these types of adoption and child welfare cases in Florida is unmatched.
